At Whispart, we believe art should speak to you. We stand behind the quality of our Los Angeles craftsmanship.
We accept returns for 30 days from the date of delivery. If you are not completely satisfied with your purchase, you may return it for a refund or exchange, subject to the terms below.
1. Damaged or Defective Items
We take quality seriously. If your art arrives damaged or with a manufacturing defect, we will replace it free of charge.
Critical Reporting Window:
You must report any damage within 48 hours of delivery.
"Destruction Proof" Option (Fastest Resolution): To save you the hassle of repacking and shipping, for clear damages, we may offer a "Destruction Proof" refund.
Instead of returning the item, you may be asked to make the artwork unusable (e.g., cut the canvas with a knife) and send us a photo proof. Once verified, we will issue a full replacement or refund immediately.
2. Standard Returns (Change of Mind)
If the item is in perfect condition but you simply changed your mind, we accept returns under these conditions:
Return Shipping: The customer is responsible for all return shipping costs. We do not provide prepaid labels for buyer's remorse.
Condition: Items must be returned in original condition and original packaging.
Restocking Fee: A 15% restocking fee will be deducted from your refund to cover initial handling and packaging materials.
No COD: We do not accept "Cash on Delivery" shipments. Packages sent COD will be rejected.
We will provide you with the Return Address and instructions.
Ship the item back using a trackable shipping method.
3. Cancellations
Before Shipping: You may cancel your order for a full refund anytime before it has entered the production phase (usually within 12 hours of ordering).
After Shipping: Once an order has shipped, it cannot be canceled. You must wait to receive it and then follow the Standard Return process.
4. Refunds
Once we receive your return (or destruction proof), please allow 3-5 business days for inspection and processing.
Refunds will be issued to your original payment method. Depending on your bank, it may take an additional 5-10 business days for the funds to appear in your account.

The following items are final sale and cannot be returned:

3. Product Descriptions & "Giclée" Disclaimer
Nature of Products: Whispart sells Giclée Canvas Prints. While our artwork may depict textures like oil paint or acrylics, the physical product is a flat reproduction printed on canvas. It does not have actual raised textures (impasto).
Colors: We make every effort to display colors accurately. However, due to monitor differences, actual print colors may vary slightly from what you see on your screen. This is not considered a defect.
4. Order Cancellation & Changes
Cancellation Window: You may cancel your order for a full refund only before it enters production (usually within 12 hours of placement). Once an order is printed, it cannot be canceled.
Address Changes: We can only update shipping addresses before the item ships. We are not responsible for packages lost due to incorrect addresses provided by the customer.
5. Shipping & Delivery
Production Time: All art is handmade to order in Los Angeles. Please allow 2-4 business days for production.
Risk of Loss: All items purchased from Whispart are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier (UPS/USPS).
Stolen Packages: If tracking shows "Delivered" but you did not receive it, you must contact the carrier directly. Whispart is not liable for stolen packages confirmed as delivered by GPS.
6. Returns, Refunds & Damages

30-Day Policy: You may return items within 30 days of delivery.
Buyer's Remorse: For non-defective returns, customer pays return shipping and a 15% restocking fee applies.
Damages: Must be reported within 48 hours of delivery with photos. We reserve the right to request Proof of Destruction (e.g., cutting the canvas) instead of a return shipment for efficient resolution.
Right to Refuse: Whispart reserves the right to refuse returns that do not meet our criteria (e.g., item damaged by customer, missing packaging).
7. Warranty Disclaimer
Whispart provides a limited warranty against manufacturing defects (e.g., loose canvas, fading ink) for 1 year from the date of purchase.
Exclusions: This warranty does not cover damage caused by accident, misuse, normal wear and tear, or environmental factors (humidity, direct sunlight).
Remedy: We will replace the defective item free of charge. Shipping costs for warranty claims are covered by Whispart.
8. Fraud Prevention & Zero Tolerance
We aggressively combat "Friendly Fraud" and "Wardrobing".
Chargebacks: Filing a false chargeback (claiming "Item Not Received" or "Defective" without proof) is a violation of these Terms and Federal Law.
Consequences: If you file a fraudulent chargeback:
Your account will be permanently banned.
We will report your identity and transaction details to FBI IC3, Signifyd, and credit bureaus.
We will pursue debt collection for the disputed amount plus legal fees.
Video Evidence: All outbound shipments are video-recorded to verify contents and condition before shipping.
9. Intellectual Property (Copyright & Trademarks)
Our Content: All content on this site (including images, text, logos, and code) is the property of Whispart and protected by U.S. and international copyright laws.
Artwork: The artwork sold on Whispart is either created in-house or licensed. Purchasing a print does not transfer any copyright or reproduction rights to you. You may not scan, copy, or resell the artwork for commercial purposes.
10. Limitation of Liability
To the fullest extent permitted by law, Whispart shall not be liable for any special, incidental, or consequential damages (including lost profits) arising from the use of, or inability to use, our products or website.
Cap on Liability: In no event shall Whispart's liability exceed the actual price paid by you for the product.

Zero Tolerance for Fraudulent Activities Whispart employs advanced fraud detection algorithms and maintains a strict zero-tolerance policy regarding "Friendly Fraud" (Chargeback Fraud), Wardrobing (buying, using, and returning), and Malicious Returns.
We reserve the right to refuse service, ban accounts, and pursue legal action against any individual suspected of abuse.
1. Chargeback Fraud & Identity Theft
Under U.S. Federal Law (18 U.S. Code § 1029 - Fraud and related activity in connection with access devices) and (15 U.S. Code § 1644 - Fraudulent use of credit cards): It is a federal crime to knowingly make false claims to a credit card issuer to obtain a refund for merchandise that was accurately described and delivered.
Consequences of False Chargebacks: If a customer files a dispute (chargeback) with their bank for a validly delivered order (e.g., claiming "Item Not Received" despite GPS delivery proof, or claiming "Defective" without providing proof):
Lifetime Ban: Your email, IP address, shipping address, and credit card billing details (last 4 digits) will be permanently blacklisted across our network and shared with third-party fraud prevention databases (e.g., Signifyd, NoFraud).
Collection Agency: The disputed amount, plus a $50 administrative penalty and all legal fees, will be forwarded to a third-party Collections Agency. This will negatively impact your Credit Score (FICO) and credit history.
Legal Reporting: We file Internet Crime Complaints with the FBI (IC3.gov) for interstate commerce fraud involving transactions over a certain threshold.
2. Malicious Intent & Return Abuse
We track return patterns. Customers with an excessive return history or those who return items that have been intentionally damaged or altered will be flagged.

3. Video Surveillance of Fulfillment
To protect our customers and our integrity, all outbound shipments are video-recorded during the packing process at our Los Angeles facility.
In the event of a "Missing Item" or "Wrong Item" claim, we will review the HD video footage of your specific order being packed.
If the footage confirms the correct item was shipped, your claim will be denied, and the footage will be submitted to your bank and federal authorities as evidence of attempted fraud.
