Whispart respects intellectual property rights and expects visitors, collectors, publishers, platforms, commercial users, and automated systems to do the same. This notice explains the rights Whispart claims, the rights it does not claim, what a collector receives, and what uses require permission.

- Commercial copying, counterfeit listings, print-on-demand use, dataset collection, and AI-model training are prohibited without written authorization.
1. Whispart materials
Whispart materials may include:
- artwork images and protectable human-created modifications, arrangements, and selections;
- collection structures, titles, written narratives, notes, product descriptions, and editorial material;
- original product photography, video, studio images, and presentation materials;
- certificates, Archive Numbers, archive records, layouts, graphics, and seal designs;
- the Whispart name, logos, slogans, collection identifiers, and distinctive brand presentation;
- website design, page arrangement, text, and databases to the extent protected by law;
- packaging designs and original printed materials; and
- confidential model, process, dataset, curation, and production records.
These materials may be protected by copyright, trademark, contract, unfair-competition, passing-off, trade-secret, database, or other applicable laws. All legally available rights are reserved.
2. Machine-learning-assisted works
Some Whispart works are created through GAN or other machine-learning-assisted processes. Human contributions may include selection and documentation of lawful training sources, model and process decisions, review of large output sets, selection and rejection, creative arrangement, editing, color and presentation decisions, naming, collection construction, writing, photography, certification, and physical presentation.
Whispart does not claim exclusive rights in:
- ideas, facts, general concepts, or artistic styles;
- public-domain source material;
- unprotectable methods or systems;
- general features dictated by materials or function; or
- machine-generated elements that applicable law does not recognize as protectable human authorship.
Whispart does assert all rights legally available in identifiable human-authored contributions and in other protected business, brand, photographic, written, contractual, and presentation materials.
3. Training-source principles
Whispart’s policy is to select training imagery from sources documented as public domain, CC0, or otherwise lawfully usable. Priority is given to reliable museum open-access collections and other sources that provide clear rights-status information.
We maintain internal evidence such as source references, authorship information, rights-status records, collection details, download dates, and cleaning records where reasonably available.
Our complete dataset inventories, source lists, cleaning rules, model configurations, training settings, and proprietary archive records are confidential business information and are not published as a public database. A general sourcing principle does not give another party permission to copy Whispart’s internal compilation, process, documentation, or final commercial presentation.
4. Ownership of the physical artwork
A completed purchase transfers ownership of the delivered physical object to the buyer. The owner may display, gift, or resell the physical object, subject to applicable law. The studio-issued certificate should accompany the work when ownership is transferred.
The purchase does not transfer:
- copyright or any claim to Whispart’s protectable human-authored material;
- the digital master, source files, high-resolution files, or production files;
- model, dataset, training, prompt, seed, workflow, or process rights;
- commercial reproduction, publication, merchandising, advertising, or licensing rights;
- trademark or brand rights; or
- the right to authorize another party to manufacture copies.
5. One-of-One does not transfer intellectual property
A One-of-One, 1/1, or Global Exclusive designation means one authorized Whispart physical edition of the designated final image. It is not a copyright assignment, trademark license, transfer of the digital master, or transfer of the underlying model or dataset.
Whispart may retain archival, evidentiary, historical, certificate, product-page, and recordkeeping copies. Whispart will not release the same designated final image again as another physical edition, digital download, or merchandise product, except for a properly recorded transit replacement after the original has been voided.
6. Personal collector sharing
A collector may photograph the physical work in the collector’s home, office, studio, or personal environment and share those photographs for personal, non-commercial purposes.
Attribution to Whispart and the work’s title is appreciated. Personal sharing does not grant Whispart permission to repost the collector’s photograph; Whispart will request permission before using customer-created content in marketing.
7. Uses requiring written permission
Without prior written authorization, you may not:
- manufacture, print, reproduce, publish, distribute, sell, or license copies;
- offer the image through print-on-demand, marketplace, stock-image, downloadable-file, wallpaper, NFT, or token services;
- use Whispart materials in commercial advertising, branding, product packaging, editorial products, or merchandise;
- remove or conceal watermarks, signatures, credits, metadata, Archive Numbers, certificates, or source identifiers;
- use Whispart photography as your own product photography;
- create a counterfeit, confusingly similar product page, storefront, account, domain, brand identity, or certificate;
- claim authorship, ownership, endorsement, affiliation, or authorization that does not exist;
- systematically scrape, download, or compile Whispart content into a dataset or image library;
- use Whispart content to train, fine-tune, evaluate, benchmark, retrieve for, or otherwise improve an AI or machine-learning system;
- upload Whispart materials to an image-to-image, style-transfer, reconstruction, prompt-recovery, or commercial derivative system; or
- create or sell commercial derivatives that reproduce protected expression or mislead customers about origin.
8. Limited linking and commentary
You may link directly to a public Whispart webpage for commentary, criticism, reporting, education, or personal recommendation, provided the use is lawful, accurate, not misleading, and does not imply sponsorship or authorization.
Any use that may independently qualify as fair use, fair dealing, or another legal exception is determined by applicable law. Nothing in this notice eliminates rights that the law grants independently.
9. Commercial and editorial licensing
Commercial, publishing, exhibition, editorial, advertising, dataset, reproduction, or merchandising use requires written authorization unless independently permitted by law.
A licensing request should identify:
- the specific work or material;
- the proposed media, purpose, territory, duration, and number of reproductions;
- the business or publication making the request;
- the proposed credit and context; and
- any deadline or expected commercial value.
Silence or failure to respond does not constitute permission.
10. Archive, certificate, and authenticity records
Whispart maintains internal creation and archive records that may include model and dataset version, generation date, output batch or seed where available, candidate records, selection notes, editing records, file hashes, product photography, Archive Number, listing date, certificate status, transaction record, replacement record, and retirement record.
A Whispart certificate documents the studio’s own production and archive record. It is not an independent appraisal, government copyright registration, guarantee of future value, or proof that no visually similar work exists anywhere in the world.
11. Trademark and brand identity
Whispart, its logos, slogans, collection identifiers, seals, and distinctive presentation may function as trademarks or source identifiers whether registered or unregistered.
They may not be used in a way likely to confuse customers, impersonate Whispart, divert orders, suggest endorsement, or misrepresent the origin of goods or services.
The absence of a registration symbol does not grant permission to copy or impersonate the brand.
12. Reporting unauthorized use of Whispart materials
To report suspected unauthorized use, email whispart1@outlook.com and include:
- a description of the Whispart material;
- the relevant Whispart page or Archive Number;
- the location of the suspected unauthorized use;
- screenshots, dates, seller names, URLs, or other evidence; and
- your contact information.
13. Reporting a concern about material displayed by Whispart
Whispart also respects the rights of other creators and rights holders. If you believe material displayed by Whispart infringes a right you own or are authorized to enforce, send a clear written notice containing:
- identification of the work or right claimed;
- identification and location of the Whispart material at issue;
- your name, email address, and other reasonable contact information;
- an explanation of your ownership or authority to act;
- a good-faith statement explaining why the use is not authorized;
- a statement that the information supplied is accurate; and
- your physical or electronic signature.
We may request additional information, temporarily limit access while reviewing a credible claim, communicate with relevant sources, or take other proportionate action. Knowingly false or materially misleading notices may create legal liability.
14. Enforcement
Whispart may preserve screenshots, source files, hashes, publication dates, archive records, certificates, product records, communications, listings, and transaction evidence.
Where appropriate, Whispart may:
- contact the responsible party and request correction, attribution, licensing, or cessation;
- submit complaints to marketplaces, social platforms, hosting providers, search engines, advertising networks, and payment providers;
- request removal or disabling of counterfeit or infringing material;
- seek preservation of evidence;
- send a formal legal notice; and
- pursue injunctions, damages, costs, or other remedies legally available when the evidence and circumstances justify it.
Whispart’s decision not to act immediately does not waive a right. Whispart does not promise to litigate every unauthorized use and will use proportionate remedies where appropriate.
15. Reservation of rights
The absence of a watermark, signature, registration, notice, certificate, or copyright symbol does not mean that a work is free to use. At the same time, Whispart does not claim rights that applicable law does not recognize.
