These Terms of Service govern your use of https://whispart.com and your purchase of Whispart products. Please read them together with our Privacy Policy, Shipping & Returns Policy, Anti-Fraud & Legal Enforcement Policy, and Copyright Ownership notice.

1. Agreement to these Terms

By accessing the website, creating an account, placing an order, or otherwise using Whispart services, you agree to these Terms. If you do not agree, do not place an order or use the website.

2. Operator and contact information

Whispart is operated by 很凉快跨境电子商务昆明有限公司. The English translation Very Cool Cross-border E-commerce Kunming Co., Ltd. is provided for identification convenience only.

3. Eligibility

You must have legal capacity to enter into a binding contract in your jurisdiction. By placing an order, you represent that the information you provide is accurate, you are authorized to use the payment method, and the purchase is lawful.

4. What Whispart makes

Whispart creates physical decorative art through a machine-learning-assisted process. Human involvement includes training-source decisions, model and process decisions, review of large output sets, selection, rejection, curation, color or presentation adjustments where appropriate, naming, collection design, physical production decisions, final studio inspection, certification, and presentation.

Whispart does not represent its works as traditionally hand-painted originals unless a product page expressly says so. Creation details may vary by collection and will be described on the relevant product page.

5. One-of-One meaning

Where a product is identified as “One-of-One,” “1/1,” or “Global Exclusive,” Whispart means that it will authorize, release, and sell only one physical Whispart edition of the designated final image.

This does not mean that:

• no visually related image, motif, style, or model output can exist anywhere;
• the buyer receives the model, training dataset, source files, or exclusive rights to an artistic style;
• Whispart must erase archival, evidentiary, product-page, or historical records; or
• the purchase transfers copyright or commercial licensing rights.

A verified transit replacement does not create a second edition. The damaged original and original certificate must be voided, and the replacement is recorded under the same Archive Number as a transit replacement.

6. Ownership of the physical object

After completion of the sale and delivery, you own the physical artwork you purchased. You may display, gift, or resell that physical object, subject to applicable law. The studio-issued certificate should remain with the work when ownership is transferred.

Ownership of the physical object does not transfer copyright, trademark rights, digital reproduction rights, model or dataset rights, source files, commercial licenses, or the right to manufacture or sell copies.

7. Archive and certificate

Each eligible work may include an Archive Number and studio-issued certificate recording information such as title, dimensions, material, creation method, issue date, 1/1 status, collector name or “Private Collection,” curatorial signature, and studio seal.

Sold works may remain visible in the Whispart archive as collected works. A work returned after certificate issuance is permanently retired, its certificate is voided, and it is not offered for sale again. The certificate supports Whispart’s own production and archive record; it is not an independent appraisal, government registration, investment guarantee, or guarantee of resale value.

8. Product descriptions and visual presentation

We make reasonable efforts to describe dimensions, framing, materials, color, and appearance accurately. Room scenes and mockups are presentation references. You should confirm scale using the dimensions stated on the product page.

• Minor screen-to-print color variation may result from displays, ambient light, printing, and material response.
• Natural solid-wood grain and minor hand-assembly character may vary.
• Finished outer dimensions may vary by up to approximately 5 mm due to physical production tolerances.
• Materially incorrect color, artwork, size, frame, or major production damage remains eligible for a remedy under the Shipping & Returns Policy.

9. Prices, taxes, and payment

Prices are shown in the currency displayed at checkout. Standard shipping to eligible U.S. addresses and ordinary import-clearance charges under our standard service are included in the listed price unless the checkout expressly states otherwise.

Applicable sales or use tax, if legally required and collected, will be shown at checkout. You are responsible for reviewing the total before authorizing payment.

Payments are processed through PayPal as commercial goods-and-services transactions. PayPal’s agreements and eligibility rules apply independently. We will never ask you to pay for a website order using PayPal Friends & Family.

10. Orders and acceptance

Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not guarantee final acceptance. We may place an order on hold, decline it, or cancel and refund it for reasons including:

• payment failure, unavailable components, or an obvious listing or pricing error;
• an address outside our supported delivery area;
• suspected unauthorized payment, fraud, abuse, or inability to verify the transaction safely;
• legal, customs, platform, or carrier restrictions; or
• a material violation of these Terms.

If we cancel an unshipped order, we will refund the amount paid for the canceled order through the original payment method.

11. Cancellation, shipping, returns, and refunds

Our Shipping & Returns Policy forms part of these Terms. It explains preparation, delivery estimates, cancellation windows, return authorization, damaged-delivery remedies, lost shipments, and refund timing.

Delivery estimates are not guaranteed arrival dates. However, we will not silently hold an order that cannot be shipped within the stated shipment period. We will provide a revised shipment date or allow cancellation and a full refund for the unshipped order.

12. Care and installation

Whispart canvas works are intended for indoor display.

• Avoid prolonged direct sunlight, high humidity, bathrooms, outdoor use, heat sources, and chemical cleaners.
• Use a dry, soft cloth on the frame and avoid rubbing the printed canvas surface.
• Use mounting hardware appropriate for the wall type and the weight of the work.
• If you are uncertain about the wall, fastener, or installation method, use a qualified installer.

To the extent permitted by law, Whispart is not responsible for damage caused by improper installation, unsuitable walls or fasteners, exposure to prohibited conditions, unauthorized modification, or misuse.

13. Permitted website use

Whispart grants you a limited, revocable, non-exclusive, and non-transferable right to access the website for personal shopping, information, and lawful interaction with the brand.

14. Prohibited use

You must not:

• attempt unauthorized access, credential attacks, card testing, malware delivery, denial-of-service activity, or security circumvention;
• use bots or automation to disrupt checkout, inventory, accounts, or normal website operation;
• systematically scrape, harvest, download, or build a dataset from Whispart images, text, or product records;
• use Whispart content to train, fine-tune, evaluate, or improve an AI or machine-learning system without written permission;
• copy product images for counterfeit, print-on-demand, resale, advertising, or misleadingly similar listings;
• impersonate Whispart or falsely suggest affiliation, endorsement, authorship, or ownership;
• submit false order, address, return, damage, non-delivery, or payment-dispute evidence; or
• use the website for unlawful, fraudulent, abusive, or rights-infringing conduct.

15. Personal sharing

A collector may take personal photographs of the physical artwork and share them for non-commercial purposes. A credit to Whispart and the work’s title is appreciated. This permission does not permit commercial reproduction, merchandising, advertising, dataset use, AI training, or sale of digital copies.

16. Third-party services

The website may use or link to independent services such as SHOPLINE, PayPal, 17TRACK, carriers, social platforms, and communication providers. Their independent terms and policies apply to their services.

17. No investment representation

Whispart artworks are sold as physical decorative and cultural objects—not as securities, financial products, or guaranteed investments. We do not promise appreciation, scarcity-driven profit, liquidity, auction acceptance, resale demand, or any particular future value.

18. Warranties and disclaimers

We warrant that the delivered product will be materially consistent with its product description and free from undisclosed major production defects. Valid problems are handled under the Shipping & Returns Policy.

To the fullest extent permitted by law, we do not guarantee uninterrupted website availability, perfect display-to-print identity, permanent resistance to all environmental conditions, or a particular emotional, aesthetic, commercial, or resale outcome.

19. Limitation of liability

To the fullest extent permitted by applicable law, Whispart will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the website or a purchase. Whispart’s aggregate contractual liability relating to a particular order will ordinarily not exceed the amount actually paid to Whispart for that order.

Nothing in these Terms excludes liability for fraud, intentional misconduct, personal injury caused by legally actionable conduct, or any responsibility that applicable law does not permit us to exclude or limit.

20. Responsibility for unlawful misuse

To the extent permitted by law, a person who unlawfully misuses the website, infringes third-party rights, commits fraud, or materially violates these Terms may be responsible for losses and reasonable enforcement costs caused by that conduct. This section does not apply to ordinary good-faith consumer complaints or lawful disputes.

21. Events beyond reasonable control

We are not responsible for delays caused by events beyond reasonable control, including severe weather, customs actions, flight disruption, war, civil disorder, epidemics, government restrictions, carrier interruption, power or network failure, or supplier interruption. We will still provide notices and remedies required by applicable law.

22. Informal resolution, PayPal rights, and governing law

Please contact Whispart first and allow up to 30 days for a good-faith attempt to resolve a dispute. This request does not limit your non-waivable rights, your ability to contact a regulator, or any applicable PayPal or card-issuer rights.

These Terms are governed by the laws of the People’s Republic of China, without depriving a consumer of mandatory protections that apply under the law of the consumer’s place of residence. Any unresolved matter will be handled by a court or other forum with lawful jurisdiction.

23. Severability and waiver

If any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law. A delay in enforcing a provision is not a waiver of the right to enforce it later.

24. Changes to these Terms

We may update these Terms when our products, services, technology, or legal obligations change. The version in effect when an order is placed will generally govern that order. Changes will not retroactively reduce rights already attached to a completed transaction where prohibited by law.
